1. Acceptance of Terms
By accessing or using the Nomad platform ("Platform"), including our website, mobile applications, and related services, you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
These Terms constitute a legally binding agreement between you and Nomad ("Company," "we," "us," or "our"). The Platform is operated by Nomad, a company incorporated under the laws of the Netherlands.
2. Description of Service
Nomad is a digital platform that connects users with parties, events, and entertainment experiences. The Platform facilitates:
- Discovery and promotion of events and parties
- Connection between event attendees, artists, and event creators
- Ticket sales and event management tools
- Artist profiles and booking services
- Social networking features related to events and entertainment
Nomad acts as an intermediary platform and does not directly organize, host, or guarantee the quality of events listed on the Platform.
3. User Accounts and Registration
3.1 Account Creation
To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to maintain its accuracy.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
3.3 Age Requirements
You must be at least 16 years old to create an account. Users under 18 may require parental consent for certain activities, particularly those involving financial transactions or attendance at age-restricted events.
4. User Conduct and Responsibilities
You agree to use the Platform in compliance with all applicable laws and regulations. You are prohibited from:
- Violating any local, national, or international laws or regulations
- Harassing, threatening, or intimidating other users
- Posting false, misleading, or deceptive content
- Infringing on intellectual property rights of others
- Attempting to gain unauthorized access to the Platform or other users' accounts
- Distributing malware, viruses, or other harmful software
- Using the Platform for commercial purposes without authorization
- Creating fake accounts or impersonating others
5. Content and Intellectual Property
5.1 User Content
You retain ownership of content you submit to the Platform ("User Content"). By submitting User Content, you grant Nomad a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display such content in connection with the Platform's operation.
5.2 Platform Content
The Platform and its original content, features, and functionality are owned by Nomad and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our express written permission.
5.3 Content Moderation
Nomad reserves the right to review, modify, or remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.
6. Payment Terms and Financial Transactions
6.1 Payment Processing
All payments on the Platform are processed by third-party payment service providers. Nomad does not store or directly process payment card information. You agree to comply with the terms and conditions of these payment providers.
6.2 Fees and Charges
Nomad may charge service fees for certain transactions, including ticket sales and event promotion services. All applicable fees will be clearly disclosed before any transaction is completed.
6.3 Refunds and Cancellations
Refund policies are determined by individual event creators and are subject to their specific terms. Nomad's role in refund processes is limited to facilitating communication between users and event creators.
7. Event Creation and Management
7.1 Event Creator Responsibilities
Event creators are responsible for ensuring their events comply with all applicable laws, regulations, and licensing requirements. This includes but is not limited to venue permissions, safety regulations, and age restrictions.
7.2 Event Information Accuracy
Event creators must provide accurate and complete information about their events, including dates, times, locations, pricing, and any special requirements or restrictions.
7.3 Event Cancellation or Changes
Event creators must promptly notify attendees of any significant changes or cancellations through the Platform. Failure to do so may result in account suspension or termination.
8. Artist and Performer Terms
8.1 Artist Profile Accuracy
Artists must provide accurate information about their services, availability, and pricing. Misrepresentation of qualifications or services may result in account termination.
8.2 Booking and Contracts
Nomad facilitates connections between artists and event creators but is not a party to booking contracts. All contractual arrangements are between the artist and event creator directly.
9. Prohibited Activities
The following activities are strictly prohibited on the Platform:
- Organizing or promoting illegal activities or events
- Discriminatory practices based on race, gender, religion, or other protected characteristics
- Fraud, scams, or deceptive business practices
- Spam, solicitation, or unsolicited commercial communications
- Violation of privacy rights or unauthorized data collection
- Activities that could harm minors or vulnerable individuals
- Circumventing Platform fees or payment systems
10. Account Termination
Nomad reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or harm to the Platform or other users.
Upon termination, your right to access and use the Platform will cease immediately. Nomad may delete your account and all associated data, subject to applicable legal requirements for data retention.
11. Disclaimers and Limitations of Liability
11.1 Platform Availability
The Platform is provided "as is" and "as available." Nomad does not guarantee uninterrupted or error-free operation of the Platform and reserves the right to modify or discontinue services at any time.
11.2 Third-Party Events and Services
Nomad is not responsible for the quality, safety, or legality of events listed on the Platform. Users attend events at their own risk and should exercise appropriate caution.
11.3 Limitation of Liability
To the maximum extent permitted by law, Nomad's liability for any damages arising from your use of the Platform is limited to the amount you have paid to Nomad in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Nomad, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.
13.2 Jurisdiction
Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Netherlands, unless otherwise required by applicable consumer protection laws.
13.3 Alternative Dispute Resolution
Before pursuing formal legal action, parties are encouraged to attempt resolution through direct negotiation or mediation.
14. Changes to Terms
Nomad reserves the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.
We recommend reviewing these Terms periodically to stay informed of any updates.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
